 True.  But it could be modified so that each level you are lower than
the spell, the chance of learning it is much more difficult.  so if 
you are one level lower, maybe 5%, 2 levels lower, 15%, 3 levels lower, 25%,
4 levels lower, 40%, or whatever.  This would make it very difficult to
learn a spell much higher than your level.

 I like the idea that your level as related to the spell level determines
casting efficiency.
