56K isn't illegal, per se. USR's implementation of x2 suffers from
(simply stated) the ISP end equipment sending to high an output into the
PSTN, exceeding current FCC and telco spec'd levels for input, when
connecting at rates above 53K.  The USR Total Control therefor limits
its sending rate to a maximum of 53K.  The Rockwell/Lucent spec employs
a slightly different algorithm for this, and is not affected (at least
publicly known or advertised) at this time.

See the white papers on both technologies for a more in-depth discussion
of this, but expect to see the USR limitation removed in the near future
as the delta to make 56K Vs 53K is negligible and arguably not an issue.
